A U.S. federal judge has decided that Elon Musk’s government program, called the Department of Government Efficiency (DOGE), can keep accessing the systems of the U.S. Department of Labor. This ruling came from Judge John Bates in Washington, D.C. and is a loss for labor unions that are worried about Musk’s influence on government agencies.
Why did the judge make this decision?
The American Federation of Labor and Congress of Industrial Organizations (AFL-CIO), a big labor union in the U.S., sued the Labor Department. They worried that Musk could access private information about government investigations involving his companies—Tesla, SpaceX, and The Boring Company—as well as details about his competitors. However, Judge Bates said that the union didn’t prove any immediate danger from Musk’s actions, so he denied their request to stop DOGE from operating.
AFL-CIO President Liz Shuler called the ruling “a setback, but not a defeat,” and said they would find better evidence for their next court appearances.
What is DOGE, and why do people worry about it?
Musk was asked by President Donald Trump to lead DOGE, which is aimed at cutting government waste and inefficiency. Some lawmakers and groups are anxious that Musk might use his power to shut down important agencies and lay off many workers.
There are also other lawsuits against DOGE. One lawsuit involves worker unions and retirees who are trying to block DOGE from getting access to sensitive payment records. Because of this, the U.S. Treasury Department has paused data transfers to DOGE while the lawsuit is active.

Musk has already made big changes in how the government works, like shutting down the U.S. Agency for International Development (USAID), which led to cancelling some contracts.
