South Korean prosecutors have charged the impeached President Yoon Suk Yeol for being the “ringleader of an insurrection.” This follows his attempt to declare martial law, which lasted only six hours on December 3. During this time, lawmakers resisted armed soldiers to stop his plan. Yoon quickly faced impeachment, and this month he became the first sitting South Korean president to be arrested.

Prosecutors say they relied on evidence from investigations to indict Yoon. They believe he may destroy evidence if released, so he will remain in jail until his trial, which must happen within six months. The charge of leading an insurrection cannot be defended by the special protections presidents usually have.

Yoon’s lawyers deny the insurrection charges and plan to fight them in court, claiming his decision to declare martial law was not an insurrection. The opposition parties welcomed the indictment, wanting to hold accountable not only those who tried to take over but also those who spread false information.

Despite facing serious charges, Yoon has his supporters, who believe he was right to declare martial law due to alleged election fraud. The case will also go to the Constitutional Court, which will decide if Yoon’s impeachment will stand. If it rules against him, he will lose the presidency, and a new election will be held in 60 days.
