Delhi MLAs Allowed to Question Services Department

Delhi MLAs can now ask questions about the Services department in Assembly sessions, thanks to a new ruling from Speaker Vijender Gupta, clarifying question admissibility.

New Delhi: The Delhi MLAs (Members of the Legislative Assembly) can now ask questions about the Services department of the Delhi government during Assembly sessions. This was announced by Speaker Vijender Gupta on Friday. In the past, MLAs complained that the Services department often did not respond to their questions because they received instructions from the Central government.

Speaker Gupta explained that according to a Supreme Court decision, questions about the Services department can be asked and answered in the Assembly. The Services department handles important matters like transfers and postings of certain government officers, including Indian Administrative Service (IAS) officers who work for Delhi. The Chief Minister leads a special group of three people that makes decisions about this.

Gupta clarified that under Article 239 AA, topics can be restricted, but not the departments. This means some departments, like Home and Land and Building, have many important tasks that are not restricted. He said that he will accept questions on restricted topics after checking each one individually.

The Speaker has the final say on what questions are acceptable, based on the assembly’s rules. Under these rules, he has the power to decide what questions can be asked and his decisions are final. No one can challenge his decision on allowing or disallowing questions.
