Senior lawyer Harish Salve has spoken out against the system that picks judges, especially after important news about Justice Yashwant Varma. There were claims of cash found at his house, and he was moved to the Allahabad High Court afterward. In interviews, Salve said this situation is making the judiciary look bad and argued that there should be more openness in how judges are selected.
Salve explained, “I have always thought the collegium system is just a temporary fix. It needs to be clear and straightforward, and that can’t happen with the collegium.” He also raised concerns about whether an internal investigation would really fix the issues or just brush them under the carpet.
He questioned the decision to transfer Justice Varma to Allahabad. Salve noted that if a judge is not fit to work, just sending them to another court isn’t the right answer. He said, “If he is capable, he should stay in Delhi. But, if there are doubts about his fitness, is he suitable for Allahabad High Court and not for Delhi? Is the Allahabad High Court just a place to move judges who are not wanted elsewhere?”
Salve pointed out what he believes is unfair treatment, saying, “If the cash had been found at someone else’s home, the Enforcement Directorate (ED) would be knocking on their door.” He called it wrong to just move a judge from one court to another without addressing the real issue. He added that if Justice Varma is trustworthy, it should be made clear to everyone
