Delhi Court to Decide on Nayeem Khan’s Communication Rights in Tihar Jail

New Delhi – The Delhi High Court is looking into a request by Nayeem Ahmad Khan, a leader who supports separating Kashmir from India. He asked why he lost the right to make phone calls and meet people online while in Tihar Jail.

On Monday, Judge Sachin Datta asked for responses from the jail officials and the National Investigation Agency (NIA). Khan’s lawyer, Tara Narula, pointed out that his phone and online meeting privileges were taken away in November 2023. This happened because the NIA didn’t give a permission letter, called a ‘no objection certificate’ (NOC).

Khan has been in jail since July 2017, facing charges related to funding terrorism connected to the 2008 Mumbai attack. The court wanted to know why the NIA blocked these communication facilities since calls can be recorded to ensure safety.

Khan’s plea argues that other inmates can still use these services, and taking them away from him is unfair. He was previously allowed to make phone calls and have online meetings before being moved within the jail. The plea claims that the NIA didn’t explain why it denied the NOC and that the restrictions violate his rights to connect with his family, which he should be able to do once a week.

Khan is asking the court to order the jail to restore his communication facilities completely. The case will be heard again on March 18.
