Hindu Marriage: Court Reaffirms Divorce Rules Within First Year

Allahabad High Court rules that Hindu marriages cannot be dissolved within a year unless serious, exceptional reasons are presented, protecting the sanctity of marriage.

The Allahabad High Court has stated that marriages between two Hindus are very important and special. According to the Hindu Marriage Act, a marriage cannot be ended within the first year unless there are very serious problems.

A group of judges, Justice Ashwani Kumar Mishra and Justice Donadi Ramesh, talked about this while reviewing a case by a couple, Nishant Bharadwaj and Rishika Gautam, who wanted to end their marriage together. They asked for a mutual divorce under a special rule, but the Family Court in Saharanpur turned down their request because they had not been married for a full year yet.

On January 15, the judges decided to reject the couple’s appeal. However, they mentioned that the couple can reapply for divorce after one year. The judges noted that there were no strong reasons given for why the couple needed a divorce so soon. They explained that simply not getting along isn’t enough to break the rules. The court said that a divorce request can be denied if there aren’t serious issues to justify breaking the one-year rule.

The law aims to protect marriages by ensuring that people don’t rush into divorce without good reason. The court emphasized that a marriage should only be ended for important reasons, and not just because the couple doesn’t get along.
