Delhi Court Upholds Gender Neutrality in Violence Case: No Bail for Accused Woman

New Delhi: The Delhi High Court recently emphasized that a fair justice system should treat everyone equally, regardless of being a man or a woman. This statement came when the court refused to grant bail to a woman accused of hurting her husband by pouring boiling water mixed with chili powder on him.

Judge Swarana Kanta Sharma said it’s important to handle all serious crimes seriously, whether the attacker is male or female. The court pointed out that it’s not fair to assume that only men can be violent or that women cannot be dangerous in domestic situations.

The court highlighted that men, who can also be victims of domestic violence, sometimes struggle to get help because of social stigma. The judge added that believing only women can be victims keeps harmful stereotypes alive.

In this case, the woman asked for leniency just because she is a woman, but the court rejected this idea. They stressed that justice should not depend on gender.

The court also commented that if the situation was reversed—if a man had attacked a woman in the same way—people would expect strict punishment. The judge stressed that courts must be free from biases related to gender.

The woman did not cooperate with the investigation, and because of that, her request for bail was denied. The judge concluded that her actions showed an intention to seriously harm her husband.
