On Tuesday, the Supreme Court refused to give custody of a young boy to Atul Subhash’s mother. Atul was a tech worker in Bengaluru who tragically died by suicide. He had claimed his wife, Nikita, and her family were bothering him and causing him distress.
Atul’s mother, Anju Devi, wanted to know where her grandson was and sought legal help for custody. She accused Nikita and her family of making false complaints against Atul, which added to his stress. Nikita, her mother Nisha, and her brother Anurag are being investigated for their role in Atul’s death, but they are currently out on bail.
During the court hearing, Nikita’s lawyers informed the judges that the child is enrolled in a boarding school in Haryana and will soon be taken to Bengaluru. The court asked for confirmation from the Haryana government about the child’s schooling.
The judges explained to Atul’s mother that since the boy’s mother, Nikita, is alive, he will mostly remain with her. They encouraged Atul’s mother to visit the child and suggested she seek official guardianship according to the law.
The Supreme Court will consider this matter again on January 20 and is focused on ensuring the child’s safety and well-being.
